These Terms of Use (“Terms”) govern your use of the website at fcitechnology.net (the “Website”), operated by FCI Technology, Inc. (“FCI Technology,” “we,” “us” or “our”). By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. Who we are

FCI Technology, Inc. supplies specialty and commodity chemicals for personal care, textiles, metal and fiber lubricants, household, industrial and institutional (HI&I) and other markets, and offers private label, manufacturing, packaging and warehousing services to businesses. 2. Using the Website

The Website is intended for businesses and adults aged 18 or older. You agree to use it only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to it, or submit false information through its forms.

Information on the Website, including product descriptions, applications, capabilities and technical information, is general information. It is not a quote, offer, specification, warranty or contract. Product specifications, Safety Data Sheets (SDS), pricing and terms of sale for your business are set in the documents we provide to you and in your purchase order, quote or supply agreement, which control if they differ from anything on the Website. Always follow the SDS and product documentation when handling our products.

The Website and its content, including text, photos, logos and graphics, belong to FCI Technology, Inc. or its licensors. You may view and share pages for your own non-commercial use, but you may not copy, modify or republish the content for commercial purposes without our written permission. FCI Technology and the FCI Technology logo are names and marks of FCI Technology, Inc.

4. Links to other websites

The Website links to other websites, such as those of our parent company, Alinea Chemical Solutions, and of Toll Solutions, which lists events we attend. We do not control those websites and are not responsible for their content or practices. Their own terms and privacy policies apply when you use them.

5. Disclaimer

The Website is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind about the Website, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Website will be uninterrupted, error-free or free of harmful components.

To the fullest extent permitted by law, FCI Technology, Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising from your use of, or inability to use, the Website. Our total liability for any claim related to the Website will not exceed one hundred U.S. dollars (US$100). Some states do not allow these limits, so they may not apply to you. These limits do not apply to products or services we provide under a separate quote, purchase order or supply agreement, which is governed by its own terms.

We may change or discontinue the Website at any time. We may also update these Terms. When we do, we will change the “Last updated” date above. Continuing to use the Website after a change means you accept the updated Terms.

8. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. Any dispute about the Website will be brought in the state or federal courts located in North Carolina. Before filing a claim, you agree to contact us first so we can try to resolve the issue informally.

9. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Website.
